I HAVE READ, UNDERSTAND AND AGREE TO THE FOLLOWING:

BOARDING

CRITERIA: All boarding accommodations are at our River West Boarding/Day Care Facility. Boarding is not available at any other location. Payment for accommodations is required at time of check-in. No minimum days for boarding. Transportation: Our multiple locations offer shorter travel times in vans. A small limit of dogs assigned to a route shortens their time during transit. Each dogs is safely transported within vehicles. There are no guaranteed specific pick-up or drop-off times. Route time can vary based on weather conditions, geographic order, and amount of dogs assigned daily. Clients doing their own transportation are expected to pick up their dogs between the hours of (7 am - 8 pm) on weekdays and (8-10 am) and (4-6 pm) on weekends. No drop-off or pick-up is available outside the weekend time parameters. Transportation is not available on Saturday or Sunday. HEALTH: As a responsible pet owner, a client must promise to keep their pet(s) up-to-date on all vaccines, including Rabies, DHPP and Bordetella, and all other state required vaccines. It is a requirement by Urban Out Sitters that each client provide official updated records from a veterinarian before using any services. Urban Out Sitters is not responsible for informing of due dates on vaccines nor will Urban Out Sitters provide vaccine records for any reason to a third party. Furthermore, when pet(s) vaccines are updated, client must submit a copy to Urban Out Sitters in order for the pet(s) to remain updated, otherwise Urban Out Sitters will assume that a pet is not current on vaccines and it will be denied service. Every pet must be healthy and free of any contagious illnesses. Each dog must be spayed or neutered past the age of (6) months prior to using service. If a dog is not spayed or neutered by (6) months of age, they will not be allowed to participate in boarding or day care with any other dogs, unless an exception is made by an Urban Out Sitters owner. There are inherent risks of illnesses when animals are allowed to be in close contact with one another or under the supervision other than the owner. Clients must realize, even when a dogs vaccines are current and verified - dogs may possibly pass an illness to one another. If you notice your dog sick prior to boarding, do not bring your dog to boarding as it could potentially contaminate the playgroup and environment. EDUCATE: Client or an authorized caregiver (whom assumes pets ownership in clients absence e.g. relative or friend) is aware of the basic services, hours, and fees offered by Urban Out Sitters as outlined on the Urban Out Sitters website www.urbanoutsitters.com to retain services for boarding and aware of all cancellation policies. Client understands and agrees to use Urban Out Sitters and the staff at Urban Out Sitters have relied on their representation that their pet(s) is/are in good health and are not harmful or show aggressive or threatening behavior towards any person or any other pet.  At time of service, if Urban Out Sitters notices a change in behavior, abnormality, or injury connected to the visits (not a 100% guarantee), it will do its best to report them to the owner. If for some unexpected reason a dog causes another dog or themselves harm, jeopardizes the safety of the playgroup or staff – Urban Out Sitters has the authority: to either separate the dog for the remainder of their stay, call an emergency contact to relinquish responsibility to an authorized third party (by client consent) or remove the dog from Urban Out Sitters and check the dog into the nearest Veterinary clinic. Client will be responsible to pay unused reservation and is financially responsible for any additional boarding, day care, transportation or medical costs. Urban Out Sitters is not liable, held accountable or guarantees any additional requests beyond the criteria outlined by Urban Out Sitters. There is no guarantee special requests will be completed, meet a client’s specific standards, accurate and accountable if the service is shared by a third party contributor other than Urban Out Sitters. INJURY:  Clients should also be aware that dogs play on different energy levels. Some are hyper and over active, while others are more calm and low-key. Scratches on the body, nicks on the ears or nose, and punctures from a misplaced tooth or a nail can possibly happen. It is possible a brawl could spark between a non-aggressive dog disliking another non-aggressive dog. Understand with regard to any injury (minor or severe) Urban Out Sitters does it best to make the owner aware of the situation or as a direct result seek immediate medical attention for their pet. Understand and agree that any problem that develops with a pet will be treated as deemed by Urban Out Sitters, staff and volunteers at their sole discretion, client assumes full financial responsibility for any and all expenses involved if client or Urban Out Sitters decide to obtain medical treatment. Urban Out Sitters is not responsible for dog injuries that can occur from a pet’s attendance and participation in boarding. Human aggressive dogs, or dogs with fear issues, will not be allowed to stay at Urban Out Sitters for boarding or day care under any circumstance. Client is to assume full financial responsibility for their pet’s veterinary emergency care, requests to pay veterinary cost toward the owners of the inflicted animal (if client choose seeks restitution), or property damages inflicted by their pet. They accept that if a pet causes any excessive damage to the facility or within their home, they are responsible to pay for repairs. FEES: ($40) for each night stay. Dogs leaving after (10am) are charged an additional $24/dog(s) for daycare. No refunds are available arriving early before the end of a scheduled service. ($10) surcharge for any major holidays. ($5) cost for each pet and each medication dose. One time ($15) Food separation/preparation surcharge for food not separated at time of check-in. ($5) Transportation fee when pet taxi shows up at residence and client did not cancel reservation. ($10) Taxi fee if a dog is dropped off after 9am at the Lakeview location, A special shuttle will be required.

DAY CARE

CRITERIA: Day care accommodations are available at River West Boarding/ Day Care Facility every day and only available at the Lakeview Facility only weekdays. No minimum days for day care. Day Care rates are set by weekly attendance. Passes are paid upfront in advance. Pup Passes are not transferable or refundable and cancellations do not apply. The 10 Day Pup Pass* offers the freedom to use day care any (10) days within (30) days without being charged an additional attendance fee. A Monthly Pup Pass* varies on the total number of weekdays within a month and offers a price break for clients in need of day care every weekday and must be used within the calendar month. Transportation: Our multiple locations offer shorter travel time allowing your dog more time at day care. ($5) cost for each pet and each medication dose. Late fee pick-up after closing time has a ($1)/per minute (each dog) charge added to the daily day care rate. If a dog is not picked up until next day, a ($40) boarding charge for overnight care is applied. A ($10) pet -taxi (each dog) from the Lakeview facility to drop off to the boarding center after 9am free pet shuttle service or after store closing time. ($5) Transportation fee when a pet taxi arrives at residence and client did not cancel reservation. Saturday and Sunday: Open office hours on weekends are drop -off (8-10am) and pick-up (4-6pm). No drop-off or pick-up is available outside the weekend time parameters. No transportation is available on Saturday and Sunday. Saturday and Sunday day care are additional charges outside the weekday regime. The Lakeview Daycare Facility does not offer weekend day care.

DOG WALKING

CRITERIA: There are no minimum days for dog walking. Puppy Walks require a (2) visit minimum per day. Puppy Walks are unavailable for dogs past the age of (6) months. Dog walking is not available on Saturday and Sunday or Holidays. HEALTH: As a responsible pet owner, a client must promise to keep their pet(s) up-to-date on all vaccines, including Rabies, DHPP and Bordetella, and all other state required vaccines. It is a requirement by Urban Out Sitters that each client provide official updated records from a veterinarian before using any services. Urban Out Sitters is not responsible for informing of due dates on vaccines nor will Urban Out Sitters provide vaccine records for any reason to a third party. Furthermore, when pet(s) vaccines are updated, client must submit a copy to Urban Out Sitters in order for the pet(s) to remain updated, otherwise Urban Out Sitters will assume that a pet is not current on vaccines and it can be denied service. There are inherent risks of illnesses when animals are allowed to be in close contact with one another or under the supervision other than the owner. Clients must realize, even when a dogs vaccines are current and verified - dogs may possibly pass an illness to one another. EDUCATE: Client or an authorized caregiver (whom assumes pets ownership in clients absence e.g. relative or friend) is aware of the basic services, hours, and fees offered by Urban Out Sitters as outlined on the Urban Out Sitters website www.urbanoutsitters.com to retain services for dog walking and aware of all cancellation policies. Client understands and agrees to use Urban Out Sitters and the staff at Urban Out Sitters have relied on their representation that their pet(s) is/are in good health and are not harmful or show aggressive or threatening behavior towards any person or any other pet.  While your away, pets that have free reign or are crated within a household and can be mischievous, by getting out of crates, damaging property, or eliminating within a home. Before service begins, Client is required to disclose to the best of their knowledge any unusual behavioral issues to better prepare Urban Out Sitters to meet service expectations. At time of service, if Urban Out Sitters notices a change in behavior, abnormality, or injury connected to the visits (not a 100% guarantee), it will do its best to report them to the owner. If for some unexpected reason a dog causes another dog or themselves harm, jeopardizes the safety of staff – Urban Out Sitters has the authority: to either discontinue service, call an emergency contact to relinquish responsibility to an authorized third party (by client consent) or check the dog into the nearest Veterinary clinic. Client will be responsible to pay unused reservation and is financially responsible for any additional transportation or medical costs. Urban Out Sitters is not liable, held accountable or guarantees any additional requests beyond the criteria outlined by Urban Out Sitters. There is no guarantee special requests will be completed, meet a client’s specific standards, accurate and accountable if the service is shared by a third party contributor other than Urban Out Sitters. INJURY: Urban Out Sitters is not responsible for dog injuries that can occur from a pet’s attendance and participation in dog walking. Human aggressive dogs, or dogs with fear issues, will not be allowed to use Urban Out Sitters for dog walking under any circumstance. Client is to assume full financial responsibility for their pet’s veterinary emergency care, requests to pay veterinary cost toward the owners of the inflicted animal (if client choose seeks restitution), or property damages inflicted by their pet. They accept that if a pet causes any excessive damage to a facility or within their home, they are responsible to pay for repairs. FEES: Must cancel same day service before 9am. After 9am client pays for dog walking cost. No refunds are available arriving early before the end of a scheduled service. ($10) surcharge for any major holidays. ($5) cost for each pet and each medication dose.

CAT CARE

CRITERIA: There are no minimum days for cat care. Cat care requires every day service. Urban Out Sitters does not offer every other day service or be absent longer then 24 hours. Urban Out Sitters does not guarantee a consistent time for each visit. HEALTH: As a responsible pet owner, a client must promise to keep their pet(s) up-to-date on all vaccines, including Rabies and all other state required vaccines. It is a requirement by Urban Out Sitters that each client provide official updated records from a veterinarian before using any services. Urban Out Sitters is not responsible for informing of due dates on vaccines nor will Urban Out Sitters provide vaccine records for any reason to a third party. Furthermore, when pet(s) vaccines are updated, client must submit a copy to Urban Out Sitters in order for the pet(s) to remain updated, otherwise Urban Out Sitters will assume that a pet is not current on vaccines and it can be denied service. There are inherent risks of illnesses when animals are allowed to be in close contact with one another or under the supervision other than the owner. Clients must realize, even when a cats vaccines are current and verified - cats may possibly pass an illness to one another. Urban Out Sitters does it best to make the owner aware of the situation or as a direct result seek immediate medical attention for their pet. Understand and agree that any problem that develops with a pet will be treated as deemed by Urban Out Sitters, staff and volunteers, at their sole discretion, client assumes full financial responsibility for any and all expenses involved if I or Urban Out Sitters decides to obtain medical treatment. They accept that if a pet causes any excessive damage to the facility or within their home are responsible to pay for repairs. FEES: Must cancel same day service before 9 am. After 9 am client pays for cat care cost. No refunds are available arriving early before the end of a scheduled service. ($10) surcharge for major holidays: booking on holiday or booking within same weekend or week. ($5) cost for each pet, each medication dose, each visit.

ADDITIONAL FEES

A $15 Food Separation Fee if good is not properly separted. Medication Fees are $5 per each dose, each medication. A one time Holiday Surcharge of $10 (each dog or entire cat service) on or during the week or weekend of a Holiday. There is no charge for webcam service. Hours: River West: Monday - Friday from 7:00 am - 8:00 pm. Staff goes off duty at 8:00 pm sharp and there is a $1.00 charge every minute for any day care pets left after 8:00 pm. Late Fees are due at time of pick-up and payable in cash or on account. If I have not picked up my dog(s) by 8:00 pm then Urban Out Sitters will board my dog(s) at the present $40 per night stay rate. Lakeview: Monday - Friday from 7:00 am - 7:00 pm. Staff goes off duty at 7:00 pm sharp and there is a $1.00 charge every minute for any day care pets left after 7:00 pm. Declined Transactions Payments are $5.00. A declined processing fee per transaction is applied to open invoices. Billing cycles: (1-2 attempts) for monthly clients, (4-5 attempts) each Friday for weekly clients.

PROMOTIONS

Urban Out Sitters deems the right to deny any promotion: a coupon or advertising campaign when proven abused, misinterpreted, misguided or misused. Concise terms of use are available with any campaign that a client is expected to uphold. No exceptions, interpretations, or manipulations will be honored. Promotions cannot be combined with other offers.

Any purchased third party coupons or vouchers beyond an expiration date, purchaser can try to redeem by contacting the originating advertiser for a cash value or can exchange for a purchase value toward a current UOS promotion equal or less then the value purchased for the coupon or voucher. No coupons, No promotions, No cash value options, No cash value or Exchange for purchase value can be used: Over a holiday or Booking a service a week around or on a holiday or specific to blackout dates. Original receipt of a voucher purchase must be supplied prior to service. 

EMERGENCY

In the event of an emergency, which includes, but is not limited to, inclement weather, natural disaster, national emergency, and animal injury or illness, Clients expressly authorize Urban Out Sitters and its staff to take any necessary steps to ensure the welfare and well being of Clients’ pet. Urban Out Sitters will attempt to contact the owner, followed by an attempt to contact the emergency contact person listed. Urban Out Sitters may directly contact the veterinarian listed, or any emergency veterinarian of Urban Out Sitters choice, if the circumstances are deemed such that immediate treatment is necessary. Clients expressly authorize Urban Out Sitters to seek emergency care for an injured animal and Urban Out Sitters is authorized to use its judgment in handling all emergencies. Clients expressly, and without limitation, release, indemnify, and hold harmless Urban Out Sitters, Inc. its agents, and employees, from any claims or causes of actions arising from actions taken by Urban Out Sitters during any emergency. Clients agree to reimburse the Urban Out Sitters for any additional fees for tending to emergency or veterinary care as well as any expenses incurred. Client also agrees to reimburse Urban Out Sitters for additional time accrued at the rate of $20 per hour in the case of such an emergency.

KEYS

Clients requesting transportation service with boarding, day care or require dog walking and cat care are required to submit (2) sets of working keys no less than 24 hours prior to service. Do not leave keys with a doorperson or on-site custodian. All locks/doorknobs must be in working condition. Keys must be provided for all locks. Provide written authorization for “Urban Out Sitters” to enter (if required). Urban Out Sitters is a bonded and insured company. In the event keys are lost, broken, or misplaced - Urban Out Sitters will not be responsible for replacement costs. Client must have a back up source in place to gain entry into home in case of an emergency. In the case of a lock out, an emergency to gain access or if no back up arrangement has been made - client assumes full financial responsibility for a locksmith, change of locks or any additional services requiring access to dwelling. Urban Out Sitters will not return keys by mail. In the event keys are lost, Urban is not liable to replace, pay or reimburse client.

Day Care and Boarding: UOS delivery windows are: Pick-Up (7am - 10am) and Drop-Off (3pm - 7pm). As dogs are placed in geographic order, route load changes daily, weather conditions, etc; therefore UOS cannot guarantee a set time of delivery service. UOS will try its best to accommodate service without key access. If for some reason a doorman is NOT present, or UOS CANNOT reach owner at the time a UOS driver arrives: -The driver will leave and continue on to the next dog. -Using drop off - the driver will return the dog back to UOS for customer pick up. Cat Care and Dog Walking: Cat Care and Dog Walking: UOS will attempt to do its best to accommodate service without key access. If for some reason a doorman is NOT present, or UOS CANNOT reach owner at the time a UOS driver arrives: -The sitter will leave and continue on to the next pet

CANCELLATIONS

RELEASE OF LIABILITY

Client or an authorized caregiver (whom assumes pets ownership in clients absence e.g. relative or friend) understands they are solely responsible for any harm caused by pet(s) while a pet is in the care of Urban Out Sitters and release Urban Out Sitters from any liability arising from a pets attendance and participation with boarding, day care, dog walking and cat care. They understand that dogs will be playing in open areas with other dogs and accept that when dogs play in groups, they will get dirty, and nicks and scratches may occur, as well as any other inherent risks that are involved and hereby release Urban Out Sitters, Inc. from any liability; A client should body check their dogs at time of pick up and address any concerns. Failure to address any issues, inflictions or concerns releases Urban Out Sitters of liability. They further understand and agree that Urban Out Sitters staff and volunteers will not be liable for any or all problems, (pets escaping, lost, dismemberment, sickness, old age, and death) which may develop with boarding, day care, dog walking or cat care. Clients expressly, and without limitation, release, indemnify, and hold harmless Urban Out Sitters, Inc., its agents, and employees, from any claims or causes of actions arising from 1) Urban Out Sitters, Inc.’s performance of its obligations under this Agreement; 2) Urban Out Sitters, Inc.’s performance of its obligations under State and Federal Law; 3) actions taken by Urban Out Sitters, Inc. during any emergency; 4) generally related to Clients’ use of Urban Out Sitters, Inc. 5) Urban Out Sitters, Inc.’s enforcement of this Agreement.

Client or an authorized caregiver (whom assumes pets ownership in clients absence e.g. relative or friend) further waive and release Urban Out Sitters, Inc. from any actions, causes of actions, damages, rights, claims or lawsuits which Clients may have for: (a) any and all personal injury or property damage which may be sustained arising from a service offered by Urban Out Sitters, this includes any interaction between dogs participating while boarding and/or day care, dog walking, or cat care and inclusive of mechanical or damages related to inside the home, within building hallway/lobby/elevator, outside walking areas, pet care belongings or pet equipment - e.g. collars, leashes, bowls, broken locks, automatic feeders and litter boxes, appliances, floors, furniture, or personal property. (b) any and all injury, illness or disease sustained by my pet arising out of or stemming from its participation using boarding and/or day care, dog walking or cat care

Webcam service is not an additional charge. Urban Out Siter is not liable if webcams are not working, they are not considered a perk, and not within the cost for services. No deductions, credits or discounts will be applied toward Urban Out Sitter pet services.

FALSE STATEMENTS

Urban Out Sitters, Inc. jealously guards its reputation for superior pet care services. Any statements published, whether on the internet or otherwise, by Clients, Clients’ agents, employees, relatives, friends, or contacts, which Urban Out Sitters, Inc. deems false, malicious, or otherwise defamatory, slanderous, or libelous, will be investigated thoroughly. Clients agree to cooperate in any such investigation, including, but not limited to, providing the name and contact information of any internet service provider, paying any and all expenses, costs, and attorneys’ fees related to any investigation and any subsequent actions brought to protect Urban Out Sitters, Inc.’s reputation or enforce the terms of this Agreement. Urban Out Sitters, Inc. retain sole discretion in determining whether any investigation is necessary, whether any action may be brought, and generally whether to enforce the terms of this Agreement.

ATTORNEY FEES AND COSTS

Should Urban Out Sitters, Inc. be forced to enforce any portion of this agreement, including, but not limited to, Clients’ failure to promptly pay invoices, Clients’ expressly agree that Urban Out Sitters, Inc. shall recover its attorneys’ fees, expenses, and costs in any action whatsoever brought to enforce this Agreement.

TERMINATION OF SERVICES

Urban Out Sitters, Inc. reserves the right to deny services or terminate this Agreement for any reason whatsoever. Client further understands that if their pet shows any signs of aggression towards other pets/person, their acceptance for service will be reevaluated and/or terminated. In the event of a termination of service, Clients agree to promptly pay any outstanding balance due.

GOVERNING LAW

Illinois Law shall govern this Agreement, and in any action brought to enforce the terms of this Agreement, Clients irrevocably submit to the jurisdiction of any State or Federal Court sitting in Chicago, Illinois.
